User Agreement

Effective: March 27, 2026

1. General Provisions

This User Agreement ("Agreement") governs your use of the ORCHESTRA.AI platform ("Platform"), operated by the Platform Owner ("we", "us"). By accessing or using the Platform, you accept this Agreement in full.

The Platform provides tools for creating and managing Telegram Mini Apps, AI-powered video generation, content management, and related services.

2. Account and Access

To use the Platform, you must authenticate via an access key provided by us. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

• You must be at least 18 years old or have parental consent.
• You agree to provide accurate information when requested.
• One person or legal entity may hold one account unless otherwise agreed.

3. Subscription Plans and Tokens

3.1 Subscription Plans

The Platform offers paid subscription plans that provide access to premium features and a monthly token allowance. Plan details, pricing, and included tokens are displayed on the Pricing page and may change with prior notice.

3.2 Tokens

• Tokens are consumed when using paid features such as AI video generation.
• Subscription tokens reset monthly upon plan renewal and do not roll over.
• Purchased token packs do not expire and remain in your account until used.
• Tokens are non-transferable and have no monetary value outside the Platform.

3.3 Payments

• Payments are processed through third-party payment providers (currently Bank CenterCredit).
• All prices are displayed in the local currency (KZT) and include applicable taxes.
• Refunds are processed at our discretion within 14 days of the original payment.

4. Acceptable Use

You agree not to:

• Use the Platform for illegal activities or to distribute harmful content.
• Attempt to bypass token limits, abuse free tiers, or exploit system vulnerabilities.
• Generate content that infringes on third-party intellectual property rights.
• Resell or redistribute Platform services without written authorization.
• Interfere with the Platform's operation or overload its infrastructure.

5. Intellectual Property

Content you create using the Platform (video, images, text) belongs to you, subject to the licenses of underlying AI models and third-party services used in generation.

The Platform, its code, design, and branding remain our intellectual property.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for downtime caused by third-party services (AI providers, payment processors, Telegram).

7. Limitation of Liability

The Platform is provided "as is." We are not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may stop using the Platform at any time. We may suspend or terminate your access for violation of this Agreement or non-payment. Upon termination, your data may be retained for 30 days before deletion.

9. Changes to this Agreement

We may update this Agreement. Continued use after changes constitutes acceptance. Material changes will be communicated via the Platform or email.
